Transcript: What options do F-1 students have if they weren’t selected in the H-1B lottery?

Hi, everyone. I’m attorney Hashim Jeelani, principal at Jeelani Law Firm. Over the last 10 years, Jeelani Law Firm has successfully filed thousands of immigration cases with agencies throughout the United States and overseas.

As F-1 students we understand the challenges you face when it comes to employment opportunities after graduation. This is especially true when dealing with the H1-1B visa process. The H-1B visa, a popular work visa for professionals, has an annual cap that often falls short of meeting the high demand. This often results in less than a 20 percent chance of being selected in the H-1B lottery. But here’s the good news: day one CPT has emerged as a viable alternative for many F-1 students who were not selected in the H-1B lottery. Day one CPT provides an opportunity to gain practical experience while continuing your studies, thereby enhancing your resume and professional skill set.

The F-1 day one CPT program provides three key advantages for F-1 students facing challenges with the H-1B lottery. Firstly, day one CPT allows you to start getting practical experience by engaging in employment from the early stages of your degree program. Hence the name, day one CPT. This early career development can give you a competitive edge in the job market when you do get selected for H-1B in the future. Secondly, since day one CPT is an F-1 program, students already on F-1 status do not need to file any change of status with USCIS to start the program. This is all done through your DSO at your intended program. And thirdly, day one CPT provides the flexibility to seek employment opportunities directly related to your program of study. This wide parameter allows for more opportunities to qualify for employment even if they wouldn’t necessarily qualify for H-1B employment. This increases your chances of securing practical training in your chosen field.

To make the most of day one CPT, there are a few important factors to consider. Number one: ensure that your University program recognizes employment or internships as an integral part of your degree curriculum. This alignment is vital to qualify for day one CPT while continuing your studies. Number two: seek employment or internships that directly relate to your program of study. Focus on opportunities that align with your educational objectives to maximize the benefits of day one CPT . And number three: obtain approval from day one CPT from your designated school official as early as possible. Your DSO will review your request, assess its compliance with program guidelines, and include relevant CPT details on your I-24. And number four: the renewal process day one CPT is typically approved on a term by term basis, or at least annually. Make sure to be in touch with your DSO to ensure that you comply with all the requirements for the renewal process.
