Transcript: How can you self-petition for your green card using the EB-2 National Interest Waiver?

So what is an EB-2 National Interest Waiver? The EB-2 National Interest Waiver, commonly referred to as an EB-2 NIW is a green card option that allows certain individuals to self-petition and obtain a green card in the United States. This means they do not need the support of an employer, nor do they need a job offer. Depending on which country you were born in, this could mean having your green card in less than one year.

Who qualifies for EB-2 NIW? To qualify for an EB-2 NIW green card applicants must either have an advanced degree in their field, such as a master’s degree, or have a bachelor’s degree with 5 years of additional experience. If you don’t have a master’s degree or a bachelor’s degree in 5 years of experience you may qualify through an alternative route as a person of exceptional ability. Exceptional ability is shown by meeting at least three of the following criteria. Number one: recognition for significant contributions in your field. Number two: membership in a professional association. Number three: a professional license to practice in your occupation. Number four: evidence of a salary commanded that reflects your exceptional ability. Number five: an official academic record demonstrating expertise and ability. Or, number six: letters showing 10 years of full-time experience in your field. In addition to having a master’s degree, its equivalent, or exceptional ability, you must also show your planned work in the US is of substantial merit, of national importance, and you are well positioned to advance the proposed work.

What professions qualify for EB-2 NIW? Although many different types of professions qualify for the EB-2 NIW, some common professions are scientists, chemical engineers, electrical engineers, mechanical engineers, physicists, biological science researchers, medical researchers, programmers, and mathematicians.
