Navigating USCIS Updates: Strengthening H-1B Integrity Measures

We at Jeelani Law Firm are committed to keeping you informed about important updates from U.S. Citizenship and Immigration Services (USCIS). We bring to your attention significant developments regarding the H-1B program, aimed at enhancing integrity measures and streamlining processes.

USCIS has announced a final rule designed to strengthen the integrity of the H-1B registration process, minimizing the potential for fraud and ensuring fairness for all beneficiaries. This includes transitioning to a beneficiary-centric selection process, where registrations will be selected based on unique beneficiaries rather than by registration. This measure aims to level the playing field, ensuring equal opportunities for all beneficiaries, regardless of the number of registrations submitted on their behalf.

Starting with the FY 2025 initial registration period, USCIS will require registrants to provide valid passport information or valid travel document information for each beneficiary. Each beneficiary must be registered under only one passport or travel document, which they intend to use when entering the United States if issued an H-1B visa.

Furthermore, USCIS has clarified requirements regarding the requested employment start date on certain petitions subject to the H-1B cap, allowing filing with requested start dates after Oct. 1 of the relevant fiscal year.

The final rule also empowers USCIS to deny or revoke H-1B petitions if the underlying registration contains false information or if the associated registration fee is declined or otherwise invalid after submission.

In addition to these integrity measures, USCIS has announced the initial registration period for the FY 2025 H-1B cap, which will run from noon Eastern on March 6, 2024, through noon Eastern on March 22, 2024.

It is crucial to note that USCIS will increase the filing fee for Form I-907 effective Feb. 26, 2024. Any filings with incorrect fees after this date will be rejected.
