New Forms Released for Immigrant Investor Program

USCIS is revising Form I-526, Immigrant Petition by Alien Entrepreneur to adapt with the EB-5 Reform and Integrity Act of 2022. The changes will help investors to file and check the eligibility requirements under the EB-5 program. This will be in effect from July 12th, 2022, and the filing fee for each form is $3,675.

This form will have two versions: Form I-526, Immigrant Petition by Standalone Investor and Form I-526E, Immigrant Petition by Regional Centre Investor. These two forms will accommodate the immigrant investors and whether or not they choose to pool their money with other foreign investors and capitalists.

  • Form I-526 will be used by standalone immigrant investors who do not want to combine their investment with additional investors seeking EB-5 classification
  • Form I-526E will be utilized by immigrant investors who do want to combine their money with other investors seeking EB-5 classification under the new regional center program
