New USCIS Extension of Premium Processing

USCIS has published a final rule on March 30, 2022 that will expand premium processing availability for certain petitions/applications starting as early as October 1, 2022. Other petition/application types will also be implemented, albeit, not until after October 1, 2024.

The following are forms that will have expedited processing available by October 1, 2022:

-Form I-140 for EB-1c (Immigrant Petition for Multinational Manager) and EB-2 National Interest Waiver

  • Expedite fee of $2,500 applies
  • Time for adjudication will be 45 days

-Form I-539 (Application to Extend/Change Nonimmigrant Status) for change to F-1 Student Status, J-1 Exchange Visitor Status, and M-1 Vocational Student Status.

  • Expedite fee of $1,750 applies
  • Time for adjudication will be 30 days

-Form I-765 (Application for Employment Authorization) for F-1 OPT applications and J-2 dependent applications

  • Expedite fee of $1,500 applies
  • Time for adjudication will be 30 days

The following are forms that will have expedited processing available by October 1, 2024:

-Form I-539 (Application to Extend/Change Nonimmigrant Status) for dependent spouses and children in E-1, E-2, E-3, H-4, L-2, O-3, P-4, and R-2 statuses

-Form I-765 (Application for Employment Authorization) for other unidentified categories
