No More Pooled-Direct EB-5 Investments Allowed

By May 18, 2022October 7th, 2022No Comments

In recent past, a popular investment alternative under the EB-5 Investor Program involved two or more investors pooling their funds together to invest in a non-regional center EB-5 project, all creating 10 jobs for each investor. Under the new EB-5 Reform and Integrity Act of 2022, this will no longer be allowed. Any investor that is pooling their funds together with another investor in hopes of qualifying through the EB-5 program may do so in ONLY a regional center project.

Investors that applied under the pooled-direct scheme prior to March 15, 2022 will be grandfathered in. After March 15, 2022, even if the investment was made at a prior date, any petition filed under the pooled-direct scheme will be denied.
