USCIS to Implement Second Phase of Premium Processing for Previously Filed EB-1 & EB-2 Form I-140 Petitions

USCIS is executing the next period of the premium processing expansion for certain petitioners who have pending I-140 under EB-1 and EB-2 classifications, which permits undocumented workers to become legal residents in the U.S. This second phase applied to those that have previously filed Form I-140 petitions under E13 multinational classifications or E21 classifications as an individual with advanced degrees or exceptional ability seeking a national interest waiver (NIW).

Beginning August 1, 2022, USCIS will accept Form I-907 requests (Premium Processing Service) for:

  • E13 multinational executive and manager positions received on or before July 1, 2021
  • E21 NIW petitions received on or before August 1, 2021.

Premium processing requests for these Form I-140 classifications will only be carried out if the date is on or before the dates listed above.

USCIS has published a new version of Form I-907, dated May 31st, 2022. As of July 1, 2022, USCIS will no longer accept the older September 30th, 2020 version of this form document. USCIS continues to work on improving these application forms to extend and change nonimmigrant statuses.
